As I pointed out in the earlier post, Nancy Boyda returned an illegal $400 cash contribution.
Accepting that cash contribution is illegal under FEC rules, giving it back is a mitigating factor in getting fined by the FEC, but does not excuse taking it in the first place.
Not only is Nancy Boyda responsible as the candidate to ensure everyone on her staff is abiding by those rules, BUT Nancy Boyda is also the treasurer of her campaign. The fact that she is the treasurer of the campaign presents all kinds of questions about the internal controls of those financial statements and how money is spent, but acting as treasurer isn't per se illegal.
Let's remember, Nancy Boyda has made a big deal in running for office, and since going to Washington, that she is trying to clean up politics. It strikes peope as hypocritical to be talking about cleaning up other people's ethics if you can't run a tight ship in your own office.
Back to the actual transactions surrounding the cash contribution. According to Boyda's reports:
The donor gave $500 March 23rd.
The donor gave $400 more on April 19th (presumably the cash).
The donor gave $500 more on June 26th.
Boyda reported REFUNDING the cash on April 16th. That's three days before she reported getting it.
At the very least, the FEC out to be asking questions about the cash being accepted. And apparently they should audit her books since her accounting seems to leave something to be desired as she's reporting refunding cash before accepting it.
[Update 7/17/07: For the commenter who questioned the fact that cash contributions over $100 are in fact prohibited, here is the paragraph directly from the Candidate's Guide:
$100 Limit on Cash Contributions
A campaign may not accept more than $100 in cash from a particular source during the entire campaign period. 110.4(c)
Oh, and contributions generally are covered by 2 U.S.C. 441a(a)(7).

Yep, that's the biggest reason not to allow a campaign to accept cash. Less temptation to put it in your pocket.

Small admissions are often done to mask a much deeper problem. I wonder if Boyda has actually accepted thousands and thousands in larger CASH contributions. I envision her accepting cash in unlabeled envelopes.

This is obviously the first FEC report you've ever scrutinized, and at stretching pretty far to make a meaningless point.
FEC says that you can only accept $100 in cash. It sounds like she refunded the remaining $400 from the $500 contribution that was from the March contribution. If it was the $400 in the 2nd contribution she would only have had to refund $300 according the the part about cash I just read on the FEC's website.

Ploger's name is still on some of the pages of her website either her staff screwed up the report or this must have happened suddenly. But then again they haven't done anything with their website since after the election so they might have forgotten they even had it.
Boyda has gotten wealthy from Jack Abramoff and the Russian oil companies, plus all the Tiller money and the $$ from the Trial Lawyers and Unions.
Boyda is so corrupt. There always seems to be a scandal or controversy involving her.
I don't think the $400 was part of the $500 because the entire contribution would have been illegal as soon as it hit $101, so I think she would have had to return the whole thing.
Also, this doesn't happen all the time. Find me another example from the federal delegation in the last year. And, her finance director should know NOT to take it, and Boyda should definitely know not to take it. I was a junior level staffer on a campaign, and we were specifically told, NO CASH.
It looks like on the FEC site Boyda is the treasurer, but it isn't illegal. Questionable, but not illegal.

Or, did someone notice she had been taking cash and called her on it. Then, and only then, did she realize she had better return it and come clean. I suspect she has taken large sums of cash from certain groups.
Anyone involved in federal campaigns (as Boyda has since 2004) knows you do not accept cash and certainly don't deposit it. You simply advise the contributor you cannot accept cash. That is a simple rule of thumb. The fact that it was accepted and deposited tells me the Boyda campaign is very loose with the campaign cash rules
